Article 496

Conditions for Allowing Application

Permission to execute a foreign judgment shall not be granted unless:

(1)

the execution of Eritrean judgments is allowed in the country in which the judgment to be executed was issued;

(2)

the judgment was issued by a court duly established and constituted;

(3)

the judgment-debtor was given the opportunity to appear and present his defense;

(4)

the judgment to be executed is final and enforceable; and

(5)

execution is not contrary to public order or morals.
