Form and Content of Petition of Habeas Corpus
The petition for release shall be accompanied by a declaration by the applicant stating the name of the person under whose custody he is being held, the nature and place of the restraint or detention, and the names of the persons, if any, who can testify to the facts alleged in the petition.
#If the person restrained or detained is unable to make the petition or affidavit, for whatever reason, then the petition and the affidavit made on his behalf shall state the name of the person restrained and that he is unable to make the application or affidavit himself.
#Notwithstanding sub-Articles (1) and (2), the petition for release may be in any form, with or without affidavit, and should include, if possible the place of the person’s detention and the responsible police officer or custodian, if known.
