Article 143
Aggravated Breach of Official Duties
A public official who commits an offence under Article 142 and in so doing:
#improperly takes or ensures for himself or another an interest in any business, property or financial transaction concerning his department; or
#concludes a contract or any other transaction at a price higher than that fixed by competent authority; or
#appropriates to himself or another cash, securities, or other objects of value that have been entrusted to him during the course of his official duties, or that have come into his hands by virtue of or in the course of his duties; or
#is guilty of an aggravated breach of official duties, punishable in the following order of graduation:
#an offence under this Article for an amount not exceeding 100,000 Nakfas, or any other benefit calculated to be equivalent to that amount, shall be punished as a Class 6 serious offence, punishable with a definite term of imprisonment of not less than 7 years and not more than 10 years;
#an offence under this Article for an amount between 100,001 and 1,000,000 Nakfas, or any other benefit calculated to be equivalent to that amount, shall be punished as a Class 5 serious offence, punishable with a definite term of imprisonment of not less than 10 years and not more than 13 years;
#an offence under this Article for an amount between 1,000,001 and 5,000,000 Nakfas, or any other benefit calculated to be equivalent to that amount, shall be punished as a Class 4 serious offence, punishable with a definite term of imprisonment of not less than 13 years and not more than 16 years;
#an offence under this Article for an amount exceeding 5,000,000 Nakfas, or any other benefit calculated to be equivalent to that amount, shall be punished as a Class 3 serious offence, punishable with a definite term of imprisonment of not less than 16 years and not more than 19 years.
