Article 278
Negligent Homicide
is guilty of negligent homicide, a Class 9 serious offence, punishable with a definite term of imprisonment of not less than 1 year and not more than 3 years.
#(2)
Negligent homicide committed by a professional person who has a legal duty to safeguard life in the course of his professional functions, shall be a Class 8 serious offence, punishable with a definite term of imprisonment of not less than 3 years and not more than 5 years.

Negligent homicide may only be prosecuted upon preferring of charges by those next of kin to the victim as described in Article 51.
