Article 1037
Abuse
(1)
The holder or owner of a house shall not cause nuisance or damage to his neighbor. He shall not cause smoke, soot, unpleasant smells, noise or vibrations in excess of good neighborly behavior, taking into account local custom, the position of the lands and the nature thereof.

Without prejudice to any claim for damages, whosoever has suffered damage or is threatened with damage by reason of another holder or owner abusing his rights may require such holder or owner to restore the former state of affairs or to take measures to prevent the occurrence of damage.
