Article 1095
Sale and Encumbrance
(1)
The competent Court may authorize a co-owner, at his request, to sell co-owned property in order to pay a debt for which the co-ownership is answerable or for other serious reasons. If a co-owner wishes to acquire it upon payment of its estimated value, the aforementioned Court may order that the co-owner for whom such property has a particular value acquires it.

This Court may authorize a co-owner, at his request, to encumber co-owned property with a right of pledge or hypothec as security for the payment of a debt for which the co-ownership is answerable, whether that debt already exists or must as yet be contracted for the preservation of co-owned property.
