Article 1104
Debt Co-Owner
(1)
In a partition, any one of the co-owners may demand that what another co-owner owes to the co-ownership be imputed to his share. Imputation takes place irrespective of the solvency of the debtor. If a debt is subject to a term; its cash value at the time of partition is its imputed value.

The preceding sub-Article does not apply to debts under a suspensive condition which has not yet been fulfilled.
