Article 1364

Form of Contracts

(1)

Unless otherwise provided, no special form shall be required and a contract is concluded, modified or terminated by the mere agreement of the parties, without any further requirements.

(2)

Where a special form is expressly prescribes by law such form shall be observed.

(3)

The parties may stipulate that the contract shall be made in a special form.
