Article 1717
Extent of Indemnity
(1)
The indemnity due is equal to the value of the thing at the time when it becomes impossible to return it in kind.
#(2)
Where the person required to make restitution knew at that time that he had no valid contractual or legal right to the thing, additional compensation may be demanded from him. In such case, the person entitled to restitution shall be placed in the position he would have been in, had he retained uninterrupted possession of the thing.
