Article 317
Mental Impairment
(1)
Where a person who is permanently or temporarily insane makes a declaration, the intention corresponding to that declaration is deemed to be lacking if the impairment of his mental capacities prevented a reasonable appraisal of the interests involved or if the declaration was made under influence of that impairment.

A declaration is presumed to have been made under the influence of the impairment, if the juridical act was prejudicial to the insane person, unless the prejudice was not reasonably foreseeable at the time of the juridical act.
