Article 15

In this Code and in the provisions of any law that defines offences:

a person negligently engages in conduct where the conduct is a marked departure from the ordinary standard of reasonable care; and

conduct is engaged in negligently in respect of a result or circumstance where it is a marked departure from the ordinary standard of reasonable care to take the risk that the result will come about or that the circumstance exists.

The standard of reasonable care shall be interpreted with regard to all the circumstances of the case, including the age, experience, education, occupation, rank and any other relevant characteristics of the accused.
