Article 290

A person who, in committing an offence of kidnapping:

carries, uses or threatens to use a weapon;

threatens to cause bodily harm to a person other than the person kidnapped or abducted and who is dependant and under the protection of the first;

wounds, maims, disfigures or otherwise causes bodily harm to the person kidnapped or abducted;

endangers the life of the person kidnapped or abducted;

holds another person for ransom or reward, or as a shield or hostage;

facilitates or attempts to facilitate the commission of another offence or flight thereafter;

facilitates or attempts to facilitate a terrorist or political objective;

kidnaps or abducts a person less than 15 years of age; or

kidnaps or abducts a person on the pretext that the person suffers from mental disorder or a dangerous condition, is guilty of aggravated kidnapping, a Class 6 serious offence, punishable with a definite term of imprisonment of not less than 7 years and not more than 10 years.

A person who commits an offence of illegal restraint under the conditions of sub-Article (1),
