Where the holder of the land above constructs drainage works on the land he holds, the landholders below shall accept without compensation the water flowing therefrom.

The holder of the land above shall construct such works as are required to reduce to a minimum the damage to be occasioned to landholders below.
The landholders below may require that the water be evacuated by means of underground pipes where, failing such pipes, the water would run on land on which buildings are erected or on gardens or yards pertaining to such buildings.
