The Court having jurisdiction shall be that of the place where the person whose death is at issue had his principal residence at the time of his death.

The Court may waive its jurisdiction in favor of the Court of the place where the event which brought about the death has occurred or in favor of the Court of another place.
The delegation of jurisdiction thus made is binding on the Court in whose favor it is made.
