When the Court delivers a judgment declaring death, it shall fix in the judgment the presumed date of the death or deaths having regard to the presumptions drawn from the circumstances of the case.

The date thus fixed may not be rectified except where it is proved that the date has been fixed as a result of fraud.
Any application having as its object the rectification of the date shall be dismissed when three years have elapsed from the date of the judgment.
