In case of death, disability, unworthiness or removal of one of the parents, the other parent shall alone exercise such function.

The mother shall exercise such function where no legal filiation link between minor child and father has been established.
After a legal filiation link between minor child and father is established, the father may request that the order is made that he and the mother be joint guardians forthwith. Art. 195 is applicable mutatis mutandis.
