A gift may not be invalidated on the ground that the donor was of unsound mind at the time of the gift unless:

the donor was interdicted at the time of the gift and the gift was not regularly made by his tutor;
an application for the interdiction of the donor was made during his life and the donor died before the application was decided on by the Court; or
the insanity of the donor can be inferred from the terms of the contract of gift.
