Where the third party institutes legal proceedings, the holder may demand to be dismissed from the case and that the dispute be settled as between the third party and the owner.
In such case, the holder of a movable may release himself from his liability to return it by depositing it at the owner's expense under conditions fixed by the Court. The holder of an immovable is entitled to a proportional reduction of the price paid for possession of the thing, where he informed the owner of the claim.
