Where there is a conflict of interests between the guardian and the minor, the Court shall appoint a guardian ad hoc to safeguard the interests of the minor.

The appointment of a guardian ad hoc shall be made on the application of the guardian or any member of the family council. The child may ask the Court to appoint a guardian ad hoc of its own motion.
The assistant guardian, if any, shall be vested by virtue of the law, with the function of guardian ad hoc.
