The farmer-tenant may in any case keep such part of the products as is necessary for his subsistence and that of the persons living with him.

The provisions of sub-Article (1) shall not apply where the products are equally necessary for the subsistence of the lessor and of those who live with him.
In such case, the products shall be divided equally between the lessor and the farmer-tenant.
