For the purpose of fixing the amount of the remission which the farmer-tenant may require, regard shall be had to the usual yield and the importance of the loss which has been sustained.

Regard shall also be had to the profits which the farmertenant made on the crops of the preceding years or which he can expect to make during the years of the lease which are still to run.
The Court shall not alter the terms of the contract unless equity so requires and to the extent necessary to enable the farmer-tenant and his family to live and to continue the exploitation.
