A person may be declared by the Court unworthy of exercising the function of guardian, where he is sentenced for a criminal offence to a punishment restrictive of personal liberty or to capital punishment.

The Court may, in passing such sentence, declare the unworthiness of the convicted person to the extent which it thinks fit, having regard to the circumstances.
