The transfer, amalgamation, division of ownership or organizational change of an undertaking may not have the effect of modifying a contract of employment.

An employee’s status, seniority, wages and any other privileges acquired through his contract of employment may be renegotiated after the transfer, amalgamation, division of ownership or organizational change of the undertaking.
The employer or owner of the undertaking shall have the responsibility of ensuring that all the rights of the employees are maintained during the transfer, amalgamation, division of ownership or organizational change of the undertaking.
