An author who has terminated his contract shall be bound to assign his rights to the publisher in preference to any other person for a period not exceeding five years from the date of termination of the contract.

He shall inform the publisher of such conditions as are proposed to him by third parties for the acquisition of these rights.
Unless the publisher notifies the author within a reasonable period whether he intends to avail himself of his prior right the right shall lapse.
