The surety may not be required to pay prior to the time fixed for the performance of the primary obligation notwithstanding that the obligation became exigible at an earlier date owing to the bankruptcy of the debtor.

Where the primary obligation is exigible only after previous notice is given to the debtor; such notice shall also be given to the surety.
The period of notice shall run as regards the surety from the day he was notified.
