To the extent he has paid the agreed compensation, the insurer is subrogated to the claim of the insured against third parties who caused the damage.

If the insured makes subrogation under sub-Article (1) impossible, the insurer may be relieved in whole or in part of his liability to the insured.
Notwithstanding any provision to the contrary, the insurer may not claim against the ascendants, descendants, mandataries or employees of the insured nor against persons living with him, unless such persons have acted maliciously.
