A settlement contract may be annulled where the dispute which it was intended to terminate has been settled by a judgment having the force of res judicata where one or both of the parties were unaware of the judgment.

Where an appeal lies from the judgment of which one or both of the parties are unaware, the settlement contract shall remain valid.
