Any action of the minor, his representatives or his heirs against the guardian, based on the liability of the latter and relating to acts by the guardian carried out in his capacity as guardian during the guardianship, shall be barred if it is not instituted within five years following the cessation of the function of the guardian.

Upon the expiry of the above period, the minor shall retain the right to claim the restitution of his property or to institute an action based on unlawful enrichment.
