The administrative decision approving the endowment shall have retroactive effect from the day of the application for the approval if such application has been made by the founder.

It shall have retroactive effect from the day of the death of the founder if the approval has been sought after the death of the founder.
Such retroactivity may not, however, be prejudicial to those persons who, in good faith, have acquired rights to the property of the endowment before such endowment has been approved.
