A partition may be effected by common agreement, provided the co-heirs were all present in person or were duly represented when the plan of partition was decided upon.

Where one of the co-heirs is a minor, the plan of partition shall be submitted to the Court.
If the Court approves the plan, it shall, with a view to assuring the interests of the minor, designate a person who shall proceed with the partition.
If the Court disapproves the plan, the succession shall be partitioned judicially.
