Where one of the heirs is indebted towards the succession, his debt shall be placed in his share, irrespective of his solvency.

If a debt is subject to a term, its cash value at the time of partition is its imputed value.
The preceding sub-Article shall not apply to debts under a suspensive condition which has not yet been fulfilled.
