After partition the creditor has to divide his claim among the heirs, in proportion to the value of the share received by each, unless the debt due to him is indivisible.

He may, however, avail himself of agreements made in the partition whereby a larger part or the whole debt is charged to one or more heirs. By accepting such agreement, he becomes a party to it.
