When the Appellate Court varies or reverses a judgment, in whole or in part, and returns the case to the lower court for further proceedings, a party may apply for, and the lower court shall order, restitution to the extent necessary to place the parties in the position which they would have occupied but for such judgment.

For the purpose of sub-Article (1), the court may make such orders as are appropriate, including orders for the refund of costs and for the payment of interest, damages, compensation and mesne profits.
No suit shall be instituted for the purpose of obtaining any restitution or other relief which could be obtained by application under sub-Article (1).
