When a party loses its capacity to be a party to a suit, the court shall, upon application, substitute a legal representative.

All acts undertaken before the legal representative enters the suit shall bind him to the extent that they would have bound the party itself.
If within one year after the loss of capacity, no application is made under sub-Article (1), the suit shall be abated as far as that party is concerned and the court may award to him the costs that he may have incurred.
