The court of appeal may admit and consider fresh evidence, or compel the submission thereof, if it is satisfied that such evidence is necessary for a just determination of the case and is otherwise admissible under the provisions of this Code and in any case where the court admits new evidence it shall record its reasons for doing so in its judgment.
