The provisions of this Code shall apply from the day of its coming into force to all cases pending on that day or in which charges are filed thereafter, except as provided in sub-Article (2).

Any trial or appeal being conducted in a trial or appellate Court on the date of the coming into force of this Code shall be completed by that Court under the procedures contained in the Transitional Criminal Procedure Code of Eritrea.
The right of review of cases decided prior to the Proclamation enacting this Code shall be governed by this Code.
