Any person may complain to the police or prosecutor that an offence has been, is being, or may be committed. Consistent with Article 24(1), when the complaint is made to the public prosecutor, the prosecutor shall carry out the investigation himself or forward it to the competent police officer with a view to an investigation being made.

If a complaint is made to a person who does not have the authority to investigate that complaint, the complaint shall be referred to the person with such authority.
