Except as provided in Article 64, the prosecutor shall commence proceedings in accordance with the provisions of this Chapter whenever in his opinion there is sufficient evidence that an offence has been committed by the accused.

If the prosecutor decides that further investigation shall be conducted in order to decide whether to institute a case against the accused, he shall make such decision within fifteen (15) days of receipt of the police report (Article 59).
