The injured party and his representative shall, within 30 days from having received the decision of the prosecutor, request the Attorney General to direct the prosecutor to institute proceedings.

Where the prosecutor refuses to institute proceedings under Article 63 (1)(a), the injured party or his representative may, within thirty (30) days from having received the decision of the Attorney General under sub-Article (1), or if the Attorney General has not ruled, within sixty (60) days of having received the decision of the prosecutor, shall, in accordance with Article 67, apply to the Court for an order that the prosecutor institute proceedings.
