is guilty of dangerous driving, a Class 2 petty offence, punishable with a definite term of imprisonment of not less than 1 month and not more than 6 months, or a fine of 5,001 – 20,000 Nakfas, to be set in intervals of 1,000 Nakfas.
A person who operates a motor vehicle or a non-motor powered vehicle, including a bicycle or animal drawn cart, in a manner that is dangerous to the public,
is guilty of dangerous operation of a motor vehicle or a non-motor powered vehicle while intoxicated, a Class 3 petty offence, punishable with a definite term of imprisonment of not more than 1 month, or a fine of 500 – 5,000 Nakfas, to be set in intervals of 500 Nakfas.
In determining whether or not conduct constitutes dangerous driving, the Court shall have regard to all the circumstances, including the nature, condition and use of the place at which the vehicle, vessel, aircraft, railway equipment or public land transport is being operated and the amount of traffic that at the time is or might reasonably be expected to be at that place.
