is guilty of sexual assault, a Class 9 serious offence, punishable with a definite term of imprisonment of not less than 1 year and not more than 3 years.
An assault of sexual nature between spouses is punishable only where the spouses are not living together in the same household under circumstances which do not show a mutual agreement or understanding between the spouses not to live together in the same household temporarily.
Sexual assault may only be prosecuted upon the preferring of charges by the victim.
