Where a person, in fending off an unlawful assault, exceeds the limits of self-defense by using disproportionate means or by going beyond the acts necessary for averting the danger, the Court shall without restriction reduce the penalty. (Article 66)

The Court may impose no punishment where the excess committed was due to excusable fear, surprise or excitement caused by the assault.
Where a person has exceeded strict self-defense, he shall remain civilly liable for the injury caused by his excess.
