fails to provide the allowances, necessaries of life or maintenance which he owes, by virtue of family rights or of a judicial decision, to his ascendants or descendants, or to his spouse, even where divorced; or
fails to meet the financial obligations he has incurred, by virtue of law, of a judicial decision or of a formal undertaking, towards a woman whom he has made pregnant out of wedlock,
is guilty of failure to provide support, a Class 2 petty offence, punishable with a definite term of imprisonment of not less than 1 month and not more than 6 months, or a fine of 5,001 – 20,000 Nakfas, to be set in intervals of 1,000 Nakfas.
Failure to support may only be prosecuted upon the preferring of charges by the victim, or where the victim is a minor, by the victim's guardian.
