by causing the damage covered by insurance; or
by concealing or falsely pretending or affirming a fact of any kind so as to influence the payment of benefits provided by the contract, in kind, in amount, in duration, or to a particular beneficiary,
is guilty of insurance fraud, a Class 8 serious offence, punishable with a definite term of imprisonment of not less than 3 years and not more than 5 years.
