Article 1282

Expropriation in the national or public interest is not possible unless the expropriating authority first declares the project which renders expropriation necessary to serve the national or public interest.

The declaration of public utility shall be published in the Gazette of Eritrean Law and at least one national daily newspaper within fifteen days after the decision is taken.

Notwithstanding the prior sub-Articles, the declaration of public utility which renders expropriation necessary in the national or general public interest shall be announced through ample notification in the locality where the property is situated.

In each case where the owner, or the interested third party is known or can be known by consulting the registers, the declaration of public interest shall be sent to him via registered mail by the expropriating authority.
