Article 1953
Defective Thing. - J. Termination of the Contract
(1)
Where, at the time of delivery, the thing has defects of such nature that its normal use is appreciably diminished, or that make it more difficult or costly to preserve it, the holder may demand the termination of the contract.
#(2)
The holder shall have the same right where the defect occurs or is discovered after the thing has been delivered to him.
#(3)
A special use to the holder shall not be taken into consideration unless the owner knew or should have known thereof on the making of the contract.
