2. Damages
(1)
Where the owner knew or should have known of the defect of the thing at the time of delivery and failed to inform the holder thereof, he shall be liable for the injury thereby caused to the holder.

The owner shall also be liable for the injury caused to the holder during the currency of the contract through the fault of the former.
