Article 122
Acknowledgement of Service
Where the summons is served in person on the defendant, on an agent, on a pleader or on another person on behalf of the defendant, the person to whom the summons is served shall sign acknowledgment of service on the original summons.
#Where such person refuses to sign the acknowledgment, Article 121 shall apply, but the court may, if it thinks fit, rule that such person has been duly served and dispense with the requirements of Article 124 (2).
#Where the summons is served upon the defendant, his agent or pleader, an acknowledgment purporting to be signed by the defendant, the agent, the pleader or an endorsement by a postal employee that the defendant or the agent refused to take delivery may be deemed by the court issuing the summons to be prima facie proof of service.
