Article 237

When the High Court is satisfied that a foreign court wishes to obtain the evidence of a witness in any civil proceeding before it, it may, subject to the provisions of this and the next Chapter, examine such witness itself or assign the examination to the court where the witness lives.

The High Court may proceed under sub-Article (1) upon application of:

a certificate signed by the diplomatic representative of the foreign country in Eritrea and transmitted to the High Court through proper channels; or

a letter of request issued by the foreign court and transmitted to the High Court through proper channels.

The evidence taken under this article shall be sent to the proper channel which transmitted the request, along with the letter of request for transmission to the foreign court.
