Article 125

Grounds for Granting Application

No application under this Title shall be granted by the Supreme Court unless the applicant can show:

(1)

that he has not received a summons to appear; or

(2)

that he was prevented by force majeure from appearing in person or by advocate; or

(3)

that he had good cause for failing to appear for trial or that his failure to appear was not willful.
